The Hilary and Galen Weston Foundation (the “Foundation”, “we”, “us”, “our”) is committed to protecting and respecting your privacy.

This policy sets out how we collect, use, and disclose personal information and other information when you visit or use this website (the “Site”).  Please read the following carefully to understand our practices regarding your privacy.

Information you give us on the Site

You can visit the Site without registering or giving us any personal information at all.

Information automatically collected on the Site

IP Addresses and Click-Stream Data

We may automatically collect the following information when you visit the Site:

  • Technical information, including the internet protocol (IP) address used to connect your computer to the internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
  • Information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from the Site (including date and time); offerings you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

COOKIES

The Site uses cookies.  A cookie is a small file containing a string of characters and numbers that is sent to your computer when you visit a website. When you visit that website again, the cookie allows that website to recognise your browser.  To learn more about cookies, and how they can affect your privacy, visit allaboutcookies.org.  For information on the cookies used on the Site, please see “Google Analytics” below.

You can prevent the storage of cookies by a corresponding setting of your browser software; however, please note that if you do this, you may not be able to use all the features of the Site to the fullest extent possible.

GOOGLE ANALYTICS

The Site uses Google Analytics (“Google Analytics”), a third party web analysis service of Google, Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, www.google.com (“Google”). Google Analytics employs cookies that are stored to your computer in order to facilitate an analysis of your use of the Site. The information generated by these cookies, such as time, place and frequency of your visits to the Site, including your IP address, is transmitted to Google’s location in the United States and stored there.

Google may also transfer this information to third parties where required to do so by law or where such third parties process this data on Google’s behalf. Google states that it will never associate your IP address with other data held by Google.

Google Analytics also uses electronic images known as web beacons (sometimes called single pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how the Site is used.

In addition, the Site uses the Google Analytics feature UserID to track interaction data. This User ID will be additionally anonymized and encrypted and will not be linked with other data.

We will use this information to evaluate your use of the Site, compile reports on Site activity and to provide further services related to Site and internet use to us.

HOW WE USE THE INFORMATION

Information automatically collected on the Site is used as follows:

  • As referred to “Google Analytics”;
  • To operate, administer and improve the Site, and to keep the Site safe and secure;
  • As otherwise may be required or permitted by applicable laws.

We may also disclose your personal information and information automatically collected through the Site to third parties:

  • If we are under a duty to disclose or share your personal information in order to comply with any legal obligation, or as we believe in good faith may be reasonably necessary to comply with any law, regulation, rule, court order, or other lawful requests from governmental, regulatory or administrative agencies or law enforcement authorities (including in response to law enforcement or national security requirements), or in order to enforce or apply our Site’s Terms of Use, and other agreements; or to protect the rights, property, or safety of the Foundation or others;
  • As otherwise may be required or permitted by applicable law.

WHERE WE STORE YOUR PERSONAL INFORMATION

The Foundation is based in Ontario, Canada and the information (including any personal information) we collect is transferred, maintained, stored, and processed in Canada and other countries outside Canada where our or our service providers’ facilities may be located, including the United States. You understand and agree that we may store and process this information in Canada and other countries as described. The data protection and privacy laws in those countries may offer a lower level of protection than the data protection and privacy laws of Canada.  Also, this information may be subject to access requests from governments, courts, or law enforcement in Canada and foreign countries according to their laws.

CONSENT FOR COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION

By visiting, browsing or using the Site you voluntarily consent to the collection, use, and disclosure of personal information and other information as specified in this policy.  Without limiting the foregoing, we may on occasion ask you to consent when we collect, use, or disclose your personal information in specific circumstances, in which case we may ask for your consent in writing (including by electronic means) although in some circumstances we may accept your oral consent.  Your consent may be implied through your conduct with us if the purpose of the collection, use or disclosure is obvious and you voluntarily provide the information.

In addition, we may collect, use, and disclose personal information without your consent when we are required or permitted by applicable law to do so.

IS MY PERSONAL INFORMATION SECURE?

All information (including personal information) that we collect from you, or that you provide to us, is stored on secure servers.  Where you have a password which enables you to access our online grant management system on the Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will use commercially reasonable efforts to protect your personal information, we cannot guarantee the security of your information transmitted to the Site.

RETENTION OF PERSONAL INFORMATION

Personal information will be retained in accordance with this policy for as long as may be necessary or relevant for the purpose of collection, or as may be required or permitted by applicable law, after which time it may be made anonymous or destroyed unless you further consent to its continued retention.

THIRD PARTY LINKS

The Site may, from time to time, contain links to and from third party websites.  If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies.  Please check these policies before you submit any personal information to these websites.

YOUR RIGHTS

Access to and correction of personal information

You have a right to request access to your personal information and to request a correction to it if you believe it is inaccurate. If you have submitted personal information to us and would like to have access to it, or if you would like to have it corrected, you may use the Site’s online grant 

management system to review and edit your profile, or else please contact us using the contact information provided below. We will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. We may require you to verify your identity before you access your personal information.

Withdrawal of consent

Individuals have the right to withdraw their consent to the collection, use, or disclosure of personal information at any time, subject to legal or contractual restrictions and reasonable notice.  Notwithstanding the foregoing, if you withdraw consent we nonetheless reserve the right to retain, collect, use and disclose personal information without your consent where we are required or permitted by applicable law to do so.

TERMS OF USE

Welcome to the website and social media pages (collectively, the “Site”) of The Hilary and Galen Weston Foundation (the “Foundation”, “we”, “us” and “our”).  These terms of use (“Terms”) apply to your use of the Site, so please read them carefully. They do not alter in any way the terms or conditions of any grant or other agreement you may have with the Foundation.

By using the Site, you agree to these Terms. If you do not agree to these Terms, you may not use the Site.

Site Information

Information on the Site was believed to be accurate at the time it was posted, however there may be inadvertent and occasional errors and it may not be complete or current. The Foundation reserves the right to change any content and correct errors or omissions contained on the Site at any time without notice.

License and Site Access

The Foundation grants you a limited license to make use of the Site and its contents for your personal purposes (if you are an individual) or your internal purposes (if you are an organization).  You may view, download, print-out, and copy web pages and content from the Site for these permitted purposes but may not otherwise copy, modify, or use the Site or its contents.  You may use the Site only for lawful purposes. 

Any unauthorized use of the Site will terminate the license granted by these Terms and may violate applicable law including copyright laws and trademark laws.

Privacy Policy

The Foundation believes strongly in protecting user privacy and providing you notice of the Foundation’s collection, use, and disclosure of personal information and other information collected from the Site. Therefore, the Foundation has adopted a Privacy Policy that you should refer to understand how the Foundation collects, uses, and discloses information collected through the Site.

Acceptable Use Policy

By using the Site, you make the following commitments: (a) all information that you submit is truthful and accurate; (b) you are responsible for any rights clearances needed for the content you submit; (c) you will not submit advertising or commercial solicitations without our permission; (d) you will not submit content or conduct activity that is unlawful, defamatory, pornographic, indecent, harassing, threatening, violent, false, or misleading; (e) you will not infringe another’s privacy rights; (f) you will not infringe another’s patent, trademark, trade secret, copyright or other intellectual rights; (g) you will not impersonate anyone or otherwise misrepresent your affiliation with anyone; and (h) you will not upload viruses or malicious software. 

Third Party Social Networks

For our social media pages on third party social media networks (“Social Networks”), the terms of use and policies of the Social Networks also apply.  We assume no liability for the Social Networks’ acts.

Security of Communications

We provide opportunities on the Site for you to send us an email, however, we discourage you from sending us sensitive or confidential information by email because this is neither a secure nor a confidential method of communication.  If you send us an email via the Site, we may respond to you by email as well and you agree that we will not be liable for the loss, interception, misuse or alteration of any information sent by email.

Mobile Use

If you access the Site using a mobile device (e.g., a mobile phone or tablet), you might incur internet access and mobile data service fees from your service provider – such fees are your responsibility, not ours.

Intellectual Property; Restrictions

The copyright, trademarks, logos, trade names, and other intellectual property in the Site, including the Foundation logo, and the Site’s contents are the property of the Foundation or third parties.  Except as expressly set out in these Terms, your use of the Site does not grant you any right to use the Foundation’s or any third party’s copyright, trademarks, logos (including the Foundation logo), trade names or other intellectual property, all of which remain the property of their respective owner.

You will not: (a) use any data mining, robots, or similar data gathering and extraction methods to access the Site; (b) frame any logo (including the Foundation logo), trademark, pages or content found at the Site without our express written consent; (c) reverse engineer, de-compile, disassemble, or attempt to discover the source code of the Site; or (d) willfully probe, tamper with or breach the security of the Site.

Linked Websites?

In some cases, you might access a third party website from a link on the Site. Links to those other websites are for your convenience only.  Your use of that other website will be governed by the other websites’ terms and privacy policies; we assume no liability regarding your use of other websites.

Disclaimers

The Site including all contents on it is provided “as is,” “with all faults” and “as available”, without warranties or conditions of any kind. The Foundation makes no warranties or representations as to the accuracy, completeness or timeliness of the contents on the Site. The Foundation assumes no liability or responsibility for any errors or omissions on the Site.  To the extent permitted by law, we exclude all conditions, warranties, or representations that may apply to the Site or any content on it, whether express or implied. 

Limitation of Liability

To the extent permitted by applicable law, you agree that the Foundation will not be liable for direct, special, indirect, consequential, exemplary, or aggravated damages or losses, or any other damages or losses of whatsoever kind, resulting from your use of, or inability to use, the Site, or any content, virus or harmful component you may download from the Site.

Termination

The Foundation reserves the right, without notice and in its sole discretion, to terminate access to and use of the Site and any user registration, and to block or prevent future access to and use of the Site.

Miscellaneous

(a)        We have the right to change these Terms.  If we do so, we will post revised Terms and the date of the revision.  Your continued use of the Site will constitute your acceptance of the revised Terms.

(b)        These Terms are governed by and construed in accordance with the laws of Ontario and the federal laws of Canada applicable therein, without regard to conflicts of law rules that would apply a different body of law.  The parties irrevocably consent and submit to the exclusive jurisdiction of the courts located in the City of Toronto, Ontario in all disputes arising out of or relating to these Terms and waive any jurisdictional or venue defenses otherwise available. However, nothing herein precludes either of us from applying for injunctive remedies or other urgent legal relief in any jurisdiction.

(c)        You may not assign any of your rights under these Terms.  We may assign and transfer all our rights and obligations under these Terms without restriction.

(d)        If any provision of these Terms is found to be unenforceable, the remainder of the Terms will remain in full force and effect. 

(e)        If we fail to enforce any provision of these Terms, that will not operate as a waiver.

(f)        These Terms make up the entire agreement between you and us regarding the use of the Site and its contents, and supersede any prior agreement.

(g)        No modification or waiver of any provision of these Terms will be effective unless in writing.
